Terms of Service

These Terms of Service ("Terms") are an agreement between you and TRV Global LLC, a Florida limited liability company doing business as Funnels Amplified ("Funnels Amplified," "we," "our," or "us"). They cover your use of funnelsamplified.com and the Funnels Amplified software platform (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you accept them for a church or organization, you confirm you have authority to bind it. In that case, "you" means that organization.

Accounts

You must be at least 18 years old to create an account. Please give us accurate information and keep it current. You are responsible for everything that happens under your account, including activity by the team members you add. Keep your login details secure, and tell us right away if you suspect unauthorized access.

Plans, billing and renewal

  • Plans are billed in advance, either monthly or yearly, at the price shown when you sign up.
  • Your subscription renews automatically at the end of each billing period until you cancel.
  • Each plan includes a monthly allowance of text segments, emails and call minutes. Usage beyond that allowance is billed at the rates shown on our pricing page. Unused allowance does not roll over.
  • Prices do not include taxes. You are responsible for any sales or use taxes that apply.
  • We may change prices with at least 30 days' notice. New prices take effect at your next renewal.
  • If a payment fails, we may pause or suspend your account until the balance is paid.

Cancellation and refunds

You can cancel at any time. Cancellation takes effect at the end of your current billing period, and you keep access until then. Fees already paid are not refundable, including unused time on a yearly plan, unless the law requires otherwise.

Text messaging and email compliance

Churches that message people through the Services must follow every law and carrier rule that applies. That includes the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, Canada's Anti-Spam Legislation (CASL) where it applies, and the CTIA Messaging Principles. You agree that:

  • You will only text or email people who have given you the consent the law requires.
  • You will honor every opt-out request, including STOP replies, and include opt-out instructions where required.
  • You will give accurate information for carrier registration of your phone number, such as A2P 10DLC registration.
  • You will not send spam, deceptive messages or messages about prohibited content.

Carriers decide whether to approve a number and whether to deliver a message. We are not responsible for carrier delays, filtering or rejections.

Our text messages to you

If you agree to receive texts from Funnels Amplified, we may send account, support and service messages to the number you give us. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, and reply HELP for help. Agreeing to receive texts is not a condition of purchase. Carriers are not liable for delayed or undelivered messages. Acceptable use

You agree not to use the Services to:

  • Break any law or violate anyone else's rights.
  • Send unsolicited bulk messages or harass anyone.
  • Upload malware or try to break, overload or get around the security of the Services.
  • Resell, sublicense or copy the Services unless we agree in writing.
  • Collect sensitive information you have no lawful right to collect.

We may suspend or remove content or accounts that break these rules.

Your data

You own the contact data and content you put into the Services ("Customer Data"). You give us permission to host, process and transmit Customer Data only as needed to provide the Services to you. You are responsible for having the right to collect and use Customer Data. You are also responsible for telling your contacts how you use their information. Our Privacy Policy explains how we handle information.

Our property

The Services, including the software, templates, design and the Funnels Amplified name and logo, belong to us or our licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Services while your subscription is active. If you send us feedback, we may use it without owing you anything.

Third-party services

The Services connect with outside services such as social networks, payment processors, calendars and phone carriers. Your use of those services is governed by their own terms. We are not responsible for them or for changes they make.

Availability and changes

We work to keep the Services available and reliable, but we do not guarantee uninterrupted service. We may add, change or remove features over time. If we remove a major feature you pay for, we will give you reasonable notice.

Disclaimer

The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied. That includes warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise any specific result, such as a number of visitors, members or donations.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages. That includes lost profits, lost data or lost donations. Our total liability for any claim about the Services is limited to the amount you paid us in the 12 months before the claim arose.

Indemnification

You agree to defend and hold harmless TRV Global LLC and its owners, employees and contractors against claims arising from your Customer Data, your messages or your breach of these Terms. That includes claims under the TCPA or other messaging laws.

Termination

You may stop using the Services and cancel at any time. We may suspend or end your access if you break these Terms, fail to pay, or create legal or security risk for us or other customers. Before your account closes, you may export your contacts. After it closes, we may delete Customer Data as described in our Privacy Policy.

Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Any dispute will be handled in the state or federal courts located in Hillsborough County, Florida, and both parties agree to that venue. Before filing any claim, please contact us so we can try to resolve it informally.

Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date at the top. If a change is significant, we will notify account holders by email or inside the platform. If you keep using the Services after a change takes effect, you accept the updated Terms.
